TechNexusGen (“Company”, “we”, “us” or “our”) operates the website at technexusgen.com and provides software, hardware, AI, IoT and resource-hiring services. This Privacy Policy explains how we collect, use, disclose and safeguard information about you when you visit our website, contact us, or use our services.

This policy is published in accordance with the provisions of:

• Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021;
• Digital Personal Data Protection Act, 2023 (“DPDP Act”); and
• Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020.

We collect the following categories of information:

• Sensitive personal data or information (“SPDI”) as defined under the SPDI Rules, only when strictly necessary, with your prior written consent.
• Technical information such as IP address, device identifiers, browser type, operating system, referring URL, pages visited, and timestamps, collected automatically through cookies and analytics tools.
• Business information from prospects, clients and candidates including CVs, work history and references for the limited purpose of resource hiring and engagement.

We process your personal data only for the following lawful purposes:

• To respond to your enquiries and provide the services you request;
• To evaluate, shortlist and onboard candidates as part of our resource-hiring services;
• To send service updates, blog notifications, newsletters and marketing (only with your consent, which you may withdraw at any time);

• To comply with applicable Indian laws, including the DPDP Act, IT Act and tax laws; and
• To protect our legal rights, prevent fraud and enforce our terms.

• Client organisations, only the CVs and candidate information of professionals you have specifically asked us to source;
• Government, regulatory or law-enforcement authorities, when required by applicable Indian law or by a valid order; and
• Successors in the event of a merger, acquisition or sale of assets, subject to the same protections of this policy.

Where personal data is transferred outside India, we ensure that the recipient observes the same level of data protection mandated by the DPDP Act, 2023 and any other applicable law, through appropriate contractual safeguards.

Personal data is retained only for as long as is reasonably necessary to fulfil the purposes for which it was collected, or as required to comply with applicable law. Once the purpose is fulfilled, data is securely deleted or anonymised.

We implement reasonable security practices and procedures in line with Rule 8 of the SPDI Rules and ISO/IEC 27001 best practices, including encryption in transit (TLS 1.2+), access controls, regular audits and security training. Despite these safeguards, no method of internet transmission is 100% secure.

9. Your rights as a Data Principal

Under Chapter III of the DPDP Act, 2023 you have the right to:

• Access a summary of your personal data and the processing activities;
• Request correction, completion, updating or erasure of inaccurate data;
• Nominate another individual to exercise your rights in the event of death or incapacity;
• Withdraw your consent at any time; and
• Make a complaint to the Data Protection Board of India.

Our services are not directed at children below 18 years of age. We do not knowingly collect personal data of children. If we discover that we have inadvertently collected such information, we will delete it without undue delay, in line with Section 9 of the DPDP Act.

This Privacy Policy is governed by the laws of India. Any dispute arising out of or in connection with this policy shall be subject to the exclusive jurisdiction of the courts in Bangalore, Karnataka.
