The hybrid model most German enterprises now run
A small nearshore pod (2–4 engineers) for onshore-adjacent work, plus a larger Indian delivery centre (8–30 engineers) for platform, data, AI and modernisation. This preserves EU data residency for regulated modules while capturing India's cost advantage on the broader estate. Governance sits with a German program lead plus a technical lead in each geography.
Works council (Betriebsrat) considerations
Under the Betriebsverfassungsgesetz, works councils have co-determination rights over certain outsourcing decisions. Early consultation on scope, protection of German-employed roles, and clear demarcation of tasks are essential. Vendors that have delivered for German enterprises understand this and can support the documentation.
The 2026 recommendation
For a Mittelstand company modernising a legacy .NET/Java estate with 15+ engineer demand, an Indian delivery centre is almost always the right primary answer, with a small nearshore pod as required. For a defence supplier or a public-sector-adjacent SaaS, nearshore-only is often mandated. For a scale-up under EUR 20M revenue, India is now the default.
